Welcome to Ryse! By using our mobile application, you accept these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By downloading, installing or using the Ryse mobile application ("the Application", "the Service"), you agree to be bound by these Terms as well as our Privacy Policy.

If you do not accept these terms, please do not use the Application.

2. Service Description

Ryse is an AI-powered nutrition and fitness coaching mobile application that offers:

• AI scanner for nutritional meal analysis
• Food tracking and calorie calculation
• Strength training exercise tracking
• GPS tracking for cardio activities
• Progress dashboards
• Food and exercise database
• Smart iOS widget
• Offline mode for workouts and nutrition

3. Eligibility

3.1 Minimum Age

You must be at least 13 years old to use Ryse. If you are between 13 and 18 years old, you must have permission from your parents or legal guardians.

3.2 Legal Capacity

You must have the legal capacity to contract and comply with these Terms.

4. Account Creation and Security

4.1 Account Creation

• You must provide accurate, complete and up-to-date information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities performed under your account
• You must notify us immediately of any unauthorized use

4.2 One Account Per Person

You may only create one account per person. Multiple or shared accounts are prohibited.

5. Acceptable Use

5.1 You Agree NOT To:

• Use the Application for illegal or unauthorized purposes
• Attempt to circumvent the Application's security measures
• Upload offensive, defamatory or illegal content
• Use robots, scrapers or other automated means to access the Service
• Disrupt the normal operation of the Application
• Impersonate another person
• Collect data from other users without their consent
• Create multiple accounts to abuse the system
• Reverse-engineer, decompile or attempt to extract source code

5.2 Consequences

Any violation of these rules may result in immediate suspension or termination of your account, without notice or refund.

6. User Content

6.1 Your Data

You retain all rights to the content you create in the Application (meal photos, custom recipes, notes, etc.).

6.2 Limited License

By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store and process your data to provide the Service
• Analyze your meal photos via our AI
• Create anonymized statistics to improve the Service

6.3 Deletion

You can delete your content at any time. Deleting your account results in permanent deletion of all your data within 30 days.

7. Intellectual Property

7.1 Ryse Rights

The Application, its design, source code, logos, trademarks and all other content provided by Ryse are protected by intellectual property laws.

7.2 License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes.

7.3 Restrictions

• You may not copy, modify, distribute or sell the Application
• You may not create derivative products based on Ryse
• You may not use our trademarks without written permission

8. Health Information and Medical Disclaimers

8.1 Not Medical Advice

IMPORTANT: Ryse is an informational nutrition and fitness tracking tool. It DOES NOT REPLACE professional medical advice.

• Always consult a doctor before starting a new diet or exercise program
• Calorie and nutritional estimates are approximate and may contain errors
• Recommendations are not personalized to your specific medical condition
• Stop any activity immediately if you experience pain, dizziness or discomfort

8.2 Data Accuracy

• The AI scanner provides estimates that may vary by ±20% from reality
• OpenFoodFacts data is community-provided and may be inaccurate
• You are responsible for verifying and adjusting nutritional values
• Calories burned calculations are approximations based on standard formulas

8.3 Medical Conditions

If you have medical conditions (diabetes, hypertension, eating disorders, injuries, etc.), consult a healthcare professional before using the Application.

9. Limitations of Liability

9.1 Service Provided "As Is"

The Application is provided "AS IS" without warranties of any kind, express or implied.

9.2 Availability

We do not guarantee that the Service will be available permanently, without interruption or without errors. We may suspend the Service for maintenance, updates or other technical reasons.

9.3 Limitation of Liability

To the fullest extent permitted by law, Ryse will not be liable for:

• Direct, indirect, incidental or consequential damages resulting from use of the Service
• Loss of data, loss of profits or business interruption
• Physical injuries resulting from use of our exercise recommendations
• Health problems resulting from use of our nutritional estimates
• Inaccuracies in food or exercise data

9.4 Maximum Liability

Our total liability to you shall not exceed the amount paid by you in the last 12 months (or €0 if the service is free).

10. Indemnification

You agree to indemnify, defend and hold harmless Ryse, its officers, employees and partners against any claim, loss or damage resulting from:

• Your violation of these Terms
• Your use of the Service
• Your violation of a third party's rights

11. Service Modifications

11.1 Right to Modify

We reserve the right to:

• Modify, suspend or discontinue all or part of the Service at any time
• Change available features
• Impose usage limits
• Modify these Terms (with prior notification)

11.2 Notification of Changes

We will notify you of significant changes via:

• An in-app notification
• An email to your registered address
• Update of the "Last updated" date of these Terms

12. Termination

12.1 By You

You can delete your account at any time from the Application settings or by contacting us.

12.2 By Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• Your account has been inactive for more than 24 months
• We must comply with a legal obligation
• We cease to offer the Service

12.3 Effects of Termination

• You lose access to your account and data
• All your data will be deleted within 30 days
• Sections 7, 9, 10, 14 and 15 of these Terms survive termination

13. Third-Party Services

The Application uses third-party services:

• Google Gemini & Vision API: AI photo analysis
• OpenFoodFacts: Food database
• Firebase Analytics: Usage statistics
• Supabase: Data hosting

These services are governed by their own terms of service. We are not responsible for the actions of these third parties.

14. Applicable Law and Jurisdiction

14.1 Applicable Law

These Terms are governed by French and European law (GDPR).

14.2 Dispute Resolution

• In case of dispute, first contact our support: support@coach-ryze.com
• If no amicable resolution is found, French courts will have jurisdiction
• European consumers may resort to mediation via the European online dispute resolution platform

15. General Provisions

15.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Ryse.

15.2 Severability

If any provision of these Terms is deemed invalid, the other provisions remain in effect.

15.3 Waiver

Our failure to exercise a right does not constitute a waiver of that right.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any affiliated company or in case of acquisition.
